Your artwork and files
Your artwork stays yours, and the embroidery files you download are yours to use, including on products you sell and for client work. You give us only the permission we need to store, process and show your artwork so we can provide the service, and we never use it to train AI models. Please upload only artwork you own or have permission to use.
This page is part of our Terms of Service.
1. Your artwork stays yours
You keep all rights in the artwork you upload, including copyright and any trademark rights. We don't claim ownership of it.
2. You own the files you download
As between you and us, you own the embroidery files you download from Stitch and Threads. If we have any rights in those files, we transfer them to you when you download them.
Some things stay ours. Our software, stitch engine, styles and methods belong to us. You own your files, not the tools we used to make them.
Owning a file doesn't give you rights in someone else's artwork. If the artwork belongs to someone else, their rights still apply to the file and to anything you stitch with it.
Other people may upload similar artwork and get similar files. Owning your files doesn't give you rights over theirs.
3. You can use your files commercially
You can use your files for personal or business projects. For example, you can:
- stitch them on shirts, hats, bags, patches and other products you sell;
- use them for client work, like digitizing a customer's logo for their uniforms;
- use, copy, share or sell the files themselves.
We don't charge royalties, and you don't need to credit us.
There's one condition: you need the rights to the artwork itself. For example:
- If you digitize a client's logo, get their permission first.
- Sports team logos, cartoon characters, brand logos and famous artwork usually belong to someone else. You need their license to use them, especially on products you sell.
- If you're not sure, use artwork you created yourself, or ask the owner.
4. The permission you give us
To run the service, we need your permission to work with your artwork. When you upload artwork, you give us a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, process, digitize, render and display your artwork and designs. We use this license only to provide the service to you, for example to:
- create your designs, previews and files;
- keep your designs in your account so you can come back to them;
- help you when you contact us;
- keep the service secure and follow the law.
Our service providers, such as our hosting and AI providers, may do these things for us, only for these purposes.
We won't:
- sell your artwork or designs;
- show them to other users or the public;
- use them in our marketing without your written permission;
- use them to train AI models.
When the license ends. It ends when your artwork is deleted, because you asked us to delete it or because you deleted your account. After that, we remove it within 30 days, and backups cycle out within a further 30 days. We may keep specific items longer only if we need them to follow the law, or to handle a legal claim or a copyright complaint.
Who sees your artwork. No person reviews your files as part of normal processing. Our team looks at your artwork only when you ask us for help, to investigate abuse or a legal complaint, or to fix a technical problem.
5. Upload only what you have the right to use
When you upload artwork, you promise that:
- you own it, or the owner has given you permission to use it and turn it into embroidery files;
- your use of it doesn't break anyone's copyright, trademark, privacy or other rights;
- it follows the rules in section 8 of our Terms of Service, so it isn't illegal, infringing, hateful or sexually explicit.
We don't check who owns artwork before we process it. You're responsible for the artwork you upload. We may remove content, and suspend or close accounts, that break these rules.
6. We don't train AI on your artwork
We don't use your uploaded artwork or your designs to train AI models. This applies to everyone who uses Stitch and Threads.
Our Privacy Policy has more about how we handle your data.
7. Copyright and trademark complaints (notice and takedown)
We respect the rights of artists and brand owners. If you believe artwork or files on Stitch and Threads infringe your copyright, send us a notice.
Where to send it.
- Email: hello@designmusketeer.com, with "Copyright notice" in the subject line
- Mail: Design Musketeer LLC, Attn: Copyright, 26517 Danti Court, Hayward, California 94545, United States
Your notice must include:
- your physical or electronic signature (typing your full name works);
- a description of the copyrighted work you believe was infringed;
- a description of the material you believe infringes it, with enough detail for us to find it, such as a link, a file name, a screenshot or the account it's connected to;
- your name, postal address, phone number and email address;
- a statement that you believe in good faith that the use isn't authorized by the copyright owner, its agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for the owner.
What happens next. We review every notice. If it's complete and valid, we remove or disable access to the material and tell the user who uploaded it. If your notice is missing something, we may ask you for the missing details.
Counter-notice. If your content was removed and you believe that was a mistake, you can send a counter-notice to the same email or mail address. It must include:
- your physical or electronic signature;
- a description of the material that was removed and where it appeared before it was removed;
- a statement, under penalty of perjury, that you believe in good faith the material was removed by mistake or misidentification;
- your name, postal address, phone number and email address;
- a statement that you consent to the jurisdiction of the federal district court for your address (or, if you're outside the United States, any judicial district in which we may be found), and that you'll accept service of legal papers from the person who sent the original notice.
We'll send your counter-notice to the person who complained. We'll restore the material 10 to 14 business days after we receive your counter-notice, unless that person tells us first that they've filed a court action.
Repeat infringers. We close the accounts of users who repeatedly infringe other people's rights, when appropriate.
False claims. Under US law (17 U.S.C. § 512(f)), anyone who knowingly makes a false claim in a notice or counter-notice may have to pay damages. If you're not sure your rights are being infringed, consider getting legal advice first.
Trademark and other complaints. If you believe content infringes your trademark or other rights, email us the details: your contact information, the right you're relying on, and the content involved. We'll review it and take appropriate action.
